What Are the Main Obligations of an Employer in the UAE?

Employers have responsibilities covering employment contracts, wage payments, workplace safety, employee records, recruitment, leave, end-of-service benefits, termination, and other employment matters. The exact obligations depend on the applicable employment framework.

Private-sector establishments registered with MOHRE generally must pay employee wages through the applicable Wage Protection System. The current WPS framework is governed by Ministerial Resolution No. 340 of 2026, with specific exclusions and requirements.

Employers must pay wages on the applicable due date under the employment contract and WPS rules. Current UAE Government guidance states that salaries for the previous month are due on the first day of each Gregorian month under the 2026 WPS framework.

UAE law prohibits employers from withholding workers’ official documents. Employers should not retain employee passports as part of ordinary employment practices.

Employers must provide a safe and appropriate work environment and take measures to protect workers from occupational injuries and risks. This includes appropriate safety measures, training, protective equipment where required, and periodic evaluation of compliance.

Employers are generally responsible for applicable recruitment and employment costs rather than passing those costs on to workers. UAE Government guidance specifically states that recruitment and related employment costs should be borne by the employer.

Contractual changes must comply with applicable law and the required approval or consent procedures. The UAE Government states that an employer cannot replace or amend the provisions of a signed job offer without the employee’s consent and compliance with applicable requirements.

Non-compliance can expose an employer to administrative action, penalties, employee complaints, MOHRE proceedings, or employment disputes depending on the nature and seriousness of the violation.

Employers hiring Emirati employees in the private sector have additional requirements relating to work permits, employment contracts, WPS, pension and social-security registration, and Emiratization requirements. Current rules also provide a minimum monthly wage of AED 6,000 for Emiratis working in the private sector from 1 January 2026.
