Outstanding debt can create financial pressure, creditor demands, and the risk of formal recovery proceedings.

Led by Dr. Ahmed Al Ramsy, our debt negotiation lawyers work with clients to assess their financial and legal position, negotiate with creditors, structure repayment solutions, and document settlements where appropriate.

Overview

What Are Debt Negotiation Legal Services?

Debt negotiation is a legal process for reaching an agreed solution between a debtor and creditor without immediately proceeding to formal court action. Our UAE debt negotiation lawyers assist individuals and businesses in negotiating repayment terms, restructuring outstanding obligations, and seeking commercially workable settlements.

Our debt collection lawyers can also support matters where negotiations do not resolve the debt and formal recovery proceedings become necessary.

Debt negotiation may involve reviewing loan or credit agreements, outstanding balances, payment history, security documents, correspondence, and the creditor’s demands. We then assess the available options and communicate with banks, financial institutions, lenders, or other creditors on the client’s behalf.

Where appropriate, we assist with repayment plans, interest or penalty negotiations, settlement proposals, standstill arrangements, and legally documented settlement terms designed to provide greater certainty for both parties.

How it Works

Frequently asked

frequently asked questions

Can a lawyer negotiate debt with a UAE bank?

A lawyer can communicate with a bank or financial institution on behalf of a client and negotiate available settlement or repayment options, subject to the circumstances of the debt and the creditor’s willingness to agree.

A creditor may agree to a reduced settlement amount, but this is not automatic. Any reduction depends on negotiation and should be properly documented so the parties understand the terms and effect of the settlement.

Businesses experiencing cash-flow difficulties may negotiate structured repayment arrangements with lenders, suppliers, or other creditors. The appropriate structure depends on the company’s financial position and the nature of the debt.

Negotiations do not necessarily prevent a creditor from taking legal action unless the parties agree to terms that address the issue. Where proceedings are imminent, legal advice should be obtained promptly.

The consequences depend on the terms of the agreement and applicable UAE law. A breach may allow the other party to pursue the remedies provided under the settlement or underlying legal relationship.

A share transfer may require a transfer agreement, company resolutions, MOA amendments and updates to registered ownership records.

The process depends on the company’s jurisdiction, constitutional documents and any restrictions contained in existing shareholder agreements

Al Ramsy Advocates can assist with negotiations involving banks, financial institutions, lenders, and other creditors, including settlement discussions, repayment structures, and formal documentation where appropriate.
