Overview

What Are Commercial Debt Collection Legal Services?

Commercial debt collection is the legal process of recovering unpaid business debts, invoices, and other outstanding commercial obligations from companies, customers, or counterparties. Our UAE commercial debt collection lawyers assist businesses with pre-litigation recovery, formal demand notices, payment claims, and court proceedings where necessary.

Commercial debt collection may involve unpaid invoices, trade debts, outstanding balances, breached supply agreements, unpaid services, or other contractual payment obligations. We assess the underlying agreement, invoices, delivery records, correspondence, payment history, acknowledgements of debt, and available security before determining the appropriate recovery strategy.

Where an amicable solution remains possible, we negotiate with the debtor to pursue payment without unnecessary litigation. Where recovery requires formal action, our team can assist with legal notices, payment claims, Payment Orders, court proceedings, and judgment enforcement.

Businesses may also benefit from our debt settlement lawyers where the parties are seeking a structured settlement or repayment arrangement rather than immediate litigation.

Our process

Four Steps From Unpaid Debt to Recovery

Commercial debt collection requires more than sending a payment demand. We assess the legal basis of the debt, select the appropriate recovery route, and pursue enforcement where necessary.

Step 1

Review the Commercial Debt

We examine the contract, invoices, transaction records, correspondence, and evidence supporting the outstanding amount.

Step 2

Demand & Negotiate Payment

We communicate with the debtor, issue the appropriate legal demand, and explore payment or settlement where commercially appropriate.

Step 3

Pursue Legal Recovery

Where payment is not made, we initiate the appropriate legal proceedings or Payment Order process based on the circumstances of the debt.

Step 4

Enforce the Recovery

Once an enforceable order or judgment is obtained, we assist with the appropriate enforcement measures to pursue payment.

frequently asked questions

How can a company recover an unpaid commercial debt in the UAE?

A company may begin with a formal demand and negotiation. If payment is not made, the creditor may pursue the appropriate UAE court procedure, which can include a Payment Order where its legal requirements are satisfied, followed by enforcement.

A Payment Order may be available for certain established monetary debts where the statutory requirements and supporting documentation are satisfied. The appropriate procedure should be assessed based on the specific transaction and evidence.

Common evidence includes the commercial agreement, invoices, purchase orders, delivery notes, statements of account, payment records, correspondence, acknowledgements of debt, guarantees, and other documents establishing the obligation.

If the debtor does not voluntarily comply with an enforceable judgment or order, the creditor may pursue available enforcement procedures to recover the outstanding amount.

The timeframe varies depending on the amount and nature of the debt, available evidence, debtor response, court procedure, appeals, and enforcement. Straightforward documented debts may follow a more streamlined route than disputed commercial claims.

Pre-litigation negotiation can provide an opportunity to recover the debt without immediately commencing court proceedings. Any settlement or repayment arrangement should be properly documented.
