No. The 12-month rule applies to the grounds listed in Article 25(2), including sale, personal use, demolition/reconstruction and qualifying comprehensive maintenance. Separate rules apply to eviction during the tenancy for breaches such as non-payment or unauthorised subletting.
Article 25 requires the notice to state the eviction reason and be served through a Notary Public or registered mail.
Yes, subject to the statutory requirements. Unless otherwise agreed, Article 25 permits eviction where the tenant fails to pay within 30 days after receiving a notice requesting payment
Yes. Unauthorised subletting without the landlord’s written approval is an express ground for eviction under Article 25, and the eviction can extend to the subtenant.
Yes. A tenant may dispute matters such as the statutory ground, notice period, service or evidence supporting the claim. The RDC determines landlord–tenant eviction disputes filed before it.
Where possession is recovered for the owner’s or first-degree relative’s use, Article 26 prevents re-letting to a third party for at least two years for residential property and three years for non-residential property, unless the RDC permits otherwise. A former tenant may seek fair compensation if this restriction is breached.
RDC lists the latest lease/Ejari, identification documents, bank details and the eviction notice with evidence of service among the required documents, together with any other evidence supporting the claim.
RDC currently charges 3.5% of annual rent or lease value for an eviction claim, subject to a minimum of AED 500 and maximum of AED 20,000, plus applicable notification, knowledge and innovation fees.
