Yes, some property disputes may proceed through arbitration where the parties have a valid arbitration agreement and the dispute is legally capable of arbitration. UAE arbitration is governed federally by Federal Law No. 6 of 2018

Important documents can include title records, the Sale and Purchase Agreement, reservation forms, payment receipts, correspondence, notices, brokerage agreements and other evidence connected with the disputed property or transaction.

There is no single forum for every UAE property dispute. Jurisdiction depends on factors including the emirate, property location, type of dispute, parties and any valid dispute-resolution clause in the agreement.

Dubai’s Property Register and title deeds have strong statutory evidentiary value. Under Law No. 7 of 2006, Property Register data may generally only be challenged where fraud or forgery is proven.

The applicable route depends on the issue. Dubai Law No. 13 of 2008 regulates registration of off-plan dispositions through the Interim Property Register, while contractual and procedural remedies depend on the specific dispute and subsequent amendments to the framework

The available procedure depends on the property’s location and circumstances. In Dubai, the Centre for Amicable Settlement of Disputes currently has jurisdiction over applications to subdivide property held in undivided co-ownership, subject to specified exceptions.

Potentially, but the outcome depends on the contract, reason for termination or breach, payment provisions and applicable law. The SPA and transaction evidence should be reviewed before determining entitlement to a refund or forfeiture.
