What is considered theft under UAE law?

Under Federal Decree-Law No. 31 of 2021, theft involves the unlawful taking of movable property belonging to another person. The applicable penalty depends on the circumstances of the alleged offence and whether aggravating factors are present.

The penalty depends on the type and circumstances of the alleged theft. Article 443 provides at least six months’ incarceration or a fine for theft without the aggravating circumstances covered by the preceding provisions, while Article 442 establishes a minimum one-year incarceration period for specified aggravated circumstances.

A vehicle theft allegation can lead to a police investigation and potentially Public Prosecution and criminal court proceedings. The evidence may include vehicle ownership records, CCTV footage, witness statements, communications, and other material connecting the accused to the alleged taking.

A lawyer can examine CCTV footage for issues such as identification, timing, completeness, image quality, continuity, and whether the footage actually supports the allegation.
