What Are Aggravated Assault Legal Services?

Assault allegations in the UAE can range from physical altercations causing relatively limited injuries to cases involving permanent disability, weapons, multiple offenders, or other serious circumstances. Under Federal Decree-Law No. 31 of 2021 on the Crimes and Penalties Law, the applicable offense and penalty depend significantly on the consequences of the assault and the circumstances in which it occurred.

Article 390 addresses assault causing illness or inability to perform personal activities for more than twenty days, while providing a lower penalty where the consequences are less serious. More serious cases can involve permanent disability under Articles 388 and 389, while Article 392 provides additional consequences where certain assaults involve weapons, tools, or a group of at least three persons acting together.

What is the punishment for assault in the UAE?

The penalty depends on the seriousness and consequences of the assault. Under Article 390, less serious assault can result in imprisonment of up to one year and a fine of up to AED 10,000, while more serious injuries can attract more severe penalties.

A self-defense argument may be available depending on the circumstances of the incident. The evidence must be assessed to determine whether the alleged response was legally justified in light of the threat and events that occurred.

A victim may be able to provide a waiver or pursue reconciliation in cases where UAE law permits it. However, a Tanazul does not automatically terminate every criminal case; its effect depends on the offense, procedural stage, and applicable law.

Permanent disability can lead to substantially more serious criminal consequences. Article 388 addresses intentionally causing permanent disability, while Article 389 addresses assault resulting in permanent disability without the intention to cause it.

Bail or release may be available depending on the offense, circumstances, procedural stage, and decision of the competent authority. A lawyer can assess the case and submit the appropriate application.

Avoid confronting the complainant or attempting to alter or destroy evidence. Seek legal advice promptly, preserve relevant messages, photographs, videos, and other evidence, and have a lawyer assist you during police or Public Prosecution proceedings.
