What Does UAE Law Say About Financial Fraud?

The main federal provision concerning ordinary fraud is Article 451 of Federal Decree-Law No. 31 of 2021 on the Crimes and Penalties Law.

Article 451 provides for incarceration or a fine where a person uses fraudulent practices, a false name, or a false capacity to obtain movable property or a written instrument, obtain a signature, or cause the cancellation, destruction, or amendment of such an instrument with the intention of deceiving the victim. It also addresses certain unauthorized dispositions of buildings or movable property that cause harm to others.

The legal classification is therefore not determined simply by the amount of money involved. The method of deception, the property or benefit involved, the accused’s conduct, intent, and available evidence can all affect the case.

Where the alleged fraud is carried out through an information network, electronic information system, or information technology means, Article 40 of Federal Decree-Law No. 34 of 2021 on Countering Rumors and Cybercrimes addresses internet fraud.

The provision covers unlawfully obtaining movable property, a benefit, or a document, or obtaining a signature through fraudulent methods, a false name, or false impersonation through an information network, information system, or information technology means.

Financial fraud can involve using fraudulent practices, a false name, or a false capacity to obtain money, property, documents, signatures, or other benefits. Article 451 of the UAE Crimes and Penalties Law addresses fraud, while Article 40 of the Cybercrimes Law addresses fraud committed through information networks, electronic systems, or information technology means.

Settlement, reconciliation, or waiver may be legally relevant in some criminal matters, but it does not automatically terminate every financial fraud case. The effect depends on the specific offence, the person legally entitled to waive or reconcile, and the procedural stage of the case. A lawyer can assess whether a negotiated resolution is available.

Under Article 99 of the Criminal Procedures Law, the Public Prosecution may, according to the circumstances, order an accused person to be banned from travel. The restriction can be addressed through the applicable legal procedures, and Al Ramsy can advise on potential applications for removal or modification.

A failed transaction or unpaid debt is not automatically criminal fraud. The authorities and courts may examine whether the conduct satisfies the elements of the alleged offence, including the use of fraudulent practices and the intention to deceive. Where a commercial dispute has developed into a criminal complaint, legal counsel can assess whether the allegations actually establish a criminal offence.

Provisional release may be available in qualifying felony or misdemeanor cases, subject to the applicable Criminal Procedures Law and the stage of proceedings. The Public Prosecution or competent court may determine the conditions of release, including whether bail or other guarantees are required.
