Responsibility depends on the source of the leak, the lease and whether the tenant caused the damage. Under Articles 16 and 17 of Dubai Law No. 26 of 2007, the landlord is generally responsible for maintenance and defects not attributable to the tenant unless the parties agreed otherwise.
Yes. The Dubai RDC urgent petition service expressly allows requests to establish property damage or inspect leased premises. The current inspection fee is 2.5% of the annual rent, plus the applicable knowledge and innovation fees.
For jointly owned property, Article 40 of Dubai Law No. 6 of 2019 provides a ten-year liability period for defects in structural parts from the project’s completion certificate. Defective mechanical, electrical, sanitary and similar installations are generally covered for one year under the same Article.

Potentially. The legal route depends on the contract, cause of damage and technical evidence. Construction disputes involving defects can proceed through negotiation, litigation or arbitration depending on the applicable agreement and jurisdiction. The SPA, handover documentation, project status and type of defect should be reviewed. Dubai Law No. 13 of 2008 regulates the Interim Property Register for off-plan property, while Law No. 19 of 2017 amended Article 11 dealing with purchaser contractual defaults; post-completion defect liability may also involve other legislation such as Article 40 of Law No. 6 of 2019 where applicable.
