What Are Debt Settlement Legal Services?

Debt settlement is the process of negotiating with a creditor to resolve an outstanding financial obligation on agreed terms. Depending on the circumstances, the resolution may involve a lump-sum payment, reduced settlement amount, installment arrangement, restructuring, waiver of certain amounts, or another mutually agreed solution.

For consumers facing financial difficulty, UAE Central Bank regulations require licensed financial institutions to maintain mechanisms that can support financial restructuring, credit-product modification, and adjusted payment plans. The applicable framework also requires financial institutions to engage with consumers facing arrears and provide information about the consequences of continued non-payment.

Can a lawyer negotiate a debt settlement in the UAE?

A lawyer can review the underlying debt, assess the creditor’s claim, negotiate settlement terms, and assist with documenting the agreed resolution. Whether a creditor accepts a settlement depends on the circumstances and the creditor’s agreement.

A reduced settlement may be negotiated in some circumstances, but there is no automatic right to a reduction. The bank or financial institution must agree to the proposed settlement terms.

Credit card debt may be subject to negotiated settlement or revised repayment arrangements depending on the financial institution, outstanding balance, payment history, and circumstances. CBUAE consumer-protection rules address support for consumers experiencing financial difficulties and revised repayment arrangements.

A settlement resolves the debt only to the extent agreed by the parties. If the agreement states that a specified payment constitutes full and final settlement, the release terms should clearly reflect that agreement.

Settlement may still be possible after legal proceedings have started, depending on the procedural stage and circumstances. The settlement should address the existing claim or enforcement position where applicable.

Where applicable, a financial institution may issue clearance or other confirmation after the agreed settlement obligations have been satisfied. The exact documentation depends on the institution and type of debt.

Depending on your circumstances, options may include negotiating a settlement, restructuring repayment obligations, or considering the UAE insolvency framework. Federal Decree by Law No. 19 of 2019 provides a legal framework concerning insolvency, and the appropriate route depends on the nature and scale of the financial difficulties.

For debts involving licensed financial institutions, CBUAE consumer-protection standards regulate how arrears communications and debt collection are conducted, including requirements concerning the frequency and manner of communications. The standards also provide for communication with an authorized representative where the consumer requests this and gives consent.
