No. Under Federal Decree-Law No. 41 of 2024, the supervising judge may refer suitable disputes to Family Guidance where an amicable resolution appears possible. Certain matters, including urgent cases and matters where reconciliation is not feasible, are excluded.
No. Divorce proceedings under Federal Decree-Law No. 41 of 2022 are expressly exempt from referral to Family Guidance Committees and proceed directly to court.
Yes, where it is approved through the appropriate legal process. Under the 2024 Personal Status Law, a settlement reached before Family Guidance and approved by the supervising judge has the force of an enforceable instrument.
Depending on the circumstances and applicable law, the parties may address matters such as maintenance, child support, custody, visitation and financial arrangements. Dubai Personal Status Court also has jurisdiction to endorse agreements connected with divorce.
Where no settlement is reached, the unresolved dispute can proceed through the competent Personal Status Court, subject to the applicable procedural route.
Personal Status Court hearings are confidential. Family settlement discussions also deal with sensitive personal matters, although the exact confidentiality rules depend on the process being used. Dubai Courts confirms that Personal Status Court sessions are closed except to the parties, their representatives and persons authorised by the court.
