Overview

What're Arbritation Legal Services?

Employment contract review is the legal assessment of an employment agreement to identify risks, clarify obligations, and ensure the terms are consistent with applicable UAE employment law. A contract can affect your salary, working hours, leave, benefits, probation, notice period, termination rights, and post-employment obligations.

Under UAE Labour Law, employment contracts in the private sector must set out key employment terms and comply with the applicable legal framework. The UAE Government confirms that employment contracts should specify matters including the start date, type of work, workplace, duration, and salary.

Our UAE employment contract lawyers review the agreement clause by clause, identifying provisions that may create legal or financial risks and explaining what each important term means in practical terms.

We assist employees reviewing new job offers and employment contracts, as well as employers drafting or reviewing agreements, with particular attention to compensation, probation, termination, confidentiality, non-compete restrictions, working arrangements, leave, and other contractual obligations.

Why should I have my employment contract reviewed before signing?

A legal review can help identify unclear, restrictive, or unfavorable provisions before they become a source of dispute. It can also help you understand important terms relating to salary, benefits, probation, termination, confidentiality, and post-employment obligations.

A lawyer may review salary and allowances, job duties, working hours, leave, probation, notice periods, termination clauses, confidentiality, intellectual property, non-compete restrictions, benefits, and other contractual provisions.

A job offer can be reviewed before acceptance to help identify important terms and compare the offer with the proposed employment contract. The UAE Government states that the employment contract should be based on the offer letter signed by both parties.

The UAE Government states that after the job offer is signed, the employer cannot replace or amend its provisions unless the employee consents and the change is within the scope of the law, with MOHRE approval where required.

Important provisions include salary and benefits, job duties, working arrangements, probation, notice periods, termination, leave, confidentiality, intellectual property, non-compete restrictions, and any repayment or penalty provisions.

UAE Labour Law permits certain non-compete provisions where the requirements established by law are met. The UAE Government states that such restrictions must be limited to what is necessary to protect the employer’s legitimate interests and defined by time, place, and type of work.

For private-sector employment covered by UAE Labour Law, the probation period may not exceed six months. Specific notice requirements apply when employment is terminated during probation.

Mandatory legal requirements may affect whether a contractual provision can be enforced. A contract review can identify provisions that may conflict with applicable employment legislation and explain the potential implications.

Employers can obtain legal advice when drafting or reviewing employment contracts to ensure terms are clear, commercially appropriate, and consistent with applicable UAE employment requirements.

The exact liquidation process depends on the company’s legal form, jurisdiction and financial position

Employees may negotiate contractual terms before signing, subject to applicable law and the employer’s agreement. Legal review can help identify which provisions may warrant clarification or negotiation.

The employment contract or draft, job offer, any proposed amendments, and relevant policies or annexes. Additional documents may be useful where the contract forms part of a broader employment arrangement.
